These Multiplayer Gaming Services Terms and Conditions of Use ("Poker GTCU") constitute a legally binding agreement (the "Agreement") between You and BES.
Please read the detailed Poker GTCU below before accessing the partypoker Platform or using real money with the software (the "Software"). These conditions form part of the Contracts, as defined in the General Terms and Conditions of Use. The capitalised terms used are terms defined in the General Terms and Conditions of Use.

1. Poker Offer on partypoker.fr
1.1. partypoker Online Poker Game Interfaces
The partypoker online poker offer is accessible under the conditions detailed below:
- A game interface directly accessible from the Partypoker online mobile application.
- A game interface directly downloadable to the player's computer from the Poker page of the partypoker online website.
- From the Poker page of the Partypoker online website directly on the player's browser, without downloading where available.
All the available game formats, depending on the different game platforms, are detailed on our website: www.partypoker.fr.
1.2. Player Welcome
Regardless of the game platform used by the player to access the poker game interface and log in to play poker, the player must first register with partypoker.fr and create a player account according to the conditions mentioned in the General Terms and Conditions.
Subsequently, the player can consult the history of their games and the details of hands directly on the poker game platform:
- Winnings or losses in cash games
- Bets and actions of players at each street in cash games
- The rake taken for each hand in cash games
- Tournament and Sit and Go entry fees
- Winnings in tournaments and Sit and Go
- The progression of each hand in tournaments and Sit and Go
1.3. Choosing a Nickname
When connecting to the poker game interface for the first time, the player must choose a nickname. It is unique and will appear at all the game tables the player joins. A default nickname may be assigned if the player does not enter one during the first connection.
The nickname can be changed by the player once every 6 months, on all game platforms via the edit icon located to the right of the screen name.
The nickname must not harm public order or morals, particularly by being racist, defamatory, obscene, or infringing upon the rights of a third party.
In such cases, partypoker may request the player to change their nickname immediately or proceed to block or close their player account, without prejudice to any other actions it deems necessary.
1.4. Game Avatar
During player registration, a default avatar is assigned.
This avatar will appear at all the game tables the player participates in.
If desired, the player can modify their avatar from the list provided. They can also choose to hide their avatar.
1.5. Application of Time and Betting Limits per 7-Day Period
1.5.1. Application of the Game Time Limit per 7-Day Period
In accordance with the General Terms and Conditions, upon the first connection to the poker game interface, the player must set the maximum amount of time they are allowed to play poker within a 7-day period, expressed in hours on the poker game interface (7 days representing a total of 168 hours).
The player is notified when they are nearing their 7-day limit: 30 minutes before reaching it, then 10 minutes before.
If the player reaches their time limit during a tournament, Sit and Go, or Twister game, they can finish the current game but will not be allowed to play new games until the current 7-day period expires.
If the player has registered for a tournament, Sit and Go, or Twister game before reaching their time limit, they can still participate.
If the player reaches their time limit during a cash game, they can finish the current hand but will not be allowed to play new hands until the current 7-day period expires.
Afterward, from the poker game interface, the player can modify this setting at any time, either up or down. Any decrease in the maximum amount set by the player is taken into account immediately, and any increase is taken into account 48 hours after the modification. Any new request to modify the limit within this 48-hour period cancels and replaces the previous request. Furthermore, if it is an increase, the 48-hour delay restarts.
1.5.2. Application of the Betting Limit per 7-Day Period
According to the General Terms and Conditions, the player must set the amount corresponding to the total of their bets, including sports betting and poker, which includes tournament and Sit and Go entry fees (buy-ins, fees, re-buys, and add-ons) and the purchase of chips in cash games (whether the purchase is made at the start or during the game).
The total bets are recorded in 7-day periods, at the latest at the time of the first bet placed on a sports wager or poker.
If a player has reached their betting limit and tries to register for a tournament, Sit and Go, or buy chips for a Cash Game, a message will notify them that they have reached their betting limit.
In Cash Game, the player's betting limit is tested when they buy chips and possibly during a re-buy of chips during the game.
In both cases, if the amount of chips the player wants to buy exceeds their set limit, a message will notify the player that they have reached their betting limit and the purchase cannot be completed.
In tournaments and Sit and Go, the betting limit is tested during registration and for any re-buys or add-ons.
In both cases, if the amount of the desired re-buy or add-on exceeds the player's set limit, a message will notify the player that they have reached their betting limit and the re-buy or add-on cannot be completed.
1.6. Loyalty Program
By playing the Partypoker online poker games, players can automatically earn loyalty points.
The number of loyalty points earned during the month/quarter informs your tier status.
Players can receive a reward based on their tier status and the number of points achieved during the current month/quarter.
The player can check their current tier status and the remaining number of loyalty points needed to reach the next tier on the poker game platform.
The rules regarding loyalty points, the various tiers and any rewards can be found on the loyalty program page on the website www.partypoker.fr.
1.7. Tournament Registration and Deregistration
1.7.1. Before registering for a tournament, the player can view the tournament details in the tournament lobby.
A player can register for a tournament provided that the maximum number of players has not been reached. Registration is still possible after the tournament has started if the late registration period has not expired.
The start time of some tournaments may be delayed by a few minutes in order to reach the minimum required number of players to begin the tournament, avoiding its cancellation. Information about the tournament start time is displayed in the tournament lobby.
The payment methods for the tournament entry fee (Buy-in and Fees) are specified for each tournament. The accepted payment methods for tournaments are real money (euros) or tournament tickets.
Tournament tickets allow a player to register for a tournament or Sit and Go. They may be restricted to certain tournaments or Sit and Go games. Tickets have a face value in euros (e.g., 10€). They can only be used for tournaments or Sit and Go events of the same value. A 10€ ticket can only be used for a tournament or Sit and Go with a 10€ buy-in, not for a 5€ or 50€ tournament.
Tickets have an expiration date and cannot be converted into euros or transferred to the player's bank account. They must be used on a tournament or Sit and Go before their expiration date.
Players can view their available tournament tickets directly on the poker gaming platform.
Non-cash prizes (e.g., entry tickets for live tournaments) will be displayed as tickets.
If the player has paid the entry fee in euros, the balance will be immediately debited from their player account. If the player deregisters from the tournament, the amount initially debited for the entry fee will be immediately refunded to the player’s available balance.
If the player registered using a tournament ticket, the available tournament ticket balance will be immediately debited. In case of deregistration, the tournament ticket will be credited back to the player’s account. Deregistration is possible as long as the tournament has not yet started.
1.7.2. Late Registration
Most multi-table tournaments offer a late registration period during which any player can register once the tournament has started. When late registration is available for a tournament, this will be specified in the tournament lobby, along with its duration. The player will receive the same number of chips as those who were registered at the start of the tournament. This period is time-limited (e.g., 1 hour after the tournament starts). Once the late registration period has ended, it is no longer possible to register for the tournament.
1.8. Tournament Cancellation
Partypoker and/or its partners may delay or cancel a tournament without prior notice. In case of cancellation, players will be refunded the Buy-in and Fees paid using the same payment methods used for registration.
1.9. Tournament Progression
The tournament begins at the scheduled date and time indicated in the tournament lobby. Registered players must log into their player accounts to access the poker platform. They are randomly distributed across several tables.
Each player is randomly assigned a seat at one of the available tables. Similarly, in case of table creation (late registrations) and table deletion (as eliminations occur), players will be randomly moved, while maintaining a balance in the number of players per table.
All players start with the same stack of chips, receiving the same number of chips unless otherwise stated.
The blind amounts increase gradually and regularly. The blind levels have a defined duration, indicated in the tournament lobby. Durations may vary according to the tournament format.
Once a player has lost all their chips, they are eliminated from the tournament.
The nature and amount of prizes are specified in the tournament lobby.
When a player pays an entry fee, a portion is deducted by the operator, and the percentage deducted varies depending on the tournament. This is specified in the tournament lobby available in the gaming platform. The remaining amount is added to the prizepool, which winning players share.
For some tournaments, a portion of the prizepool may be deducted to create promotional prizes for certain tournament winners. The respective percentages of the tournament prizepool and the amount deducted for promotional prizes are specified in the tournament lobby, available on the gaming platform and the dedicated tournament page on the "partypoker.fr" website.
Example: In a tournament with 100 players, the winner could win 20% of the prizepool, and the 20th player could win 2% of the prizepool. Players ranked between 21st and 100th place do not win anything.
The payout structure varies according to the tournament. The first player to be eliminated finishes 100th in the tournament rankings. The next player eliminated finishes 99th, and so on.
A player enters the paid places when the next player to be eliminated receives a payout.
The winner of the tournament is the player who has all the chips in play.
1.9.1 Player Disconnection During a Hand / Inactive or Absent Player
If a player is disconnected during a hand, whether due to a voluntary or accidental disconnection from the server, the player will be given a time reserve based on the tournament model, which is indicated in the tournament lobby.
If the player does not reconnect within the allotted time, they will be placed in a sit-out (absent) state. If the player reconnects during the hand, they may continue playing. If their hand has been raised before reconnection, it will be automatically folded.
If the player is still disconnected when the hand is completed, their small blind and big blind will be collected once per round in the tournament.
1.9.2 Allocated Time and Additional Time
Each player has a set amount of time to make their moves during the game. The allotted time for decisions is specific to the tournament and is indicated in the tournament lobby.
If the allotted time expires, the player can use an additional time reserve (Time Bank) that is activated either manually or automatically, depending on the settings defined by the player in their account. This reserve is unique for the entire tournament and is not reset from hand to hand. Time used from the reserve is not recoverable. An additional time reserve is offered starting from certain blind levels and during the final table in some tournaments. Once the allotted time and the additional time reserve are used up, the player is automatically considered absent.
1.9.3. Hand by Hand
The "Hand by Hand" mode ensures that players play the same number of hands during important phases of multi-table tournaments (usually activated by the tournament organizer as the first paid place or before the final table).
When "Hand by Hand" mode is activated, all hands at every table in the tournament begin at the same time, once the previous hand at each table is finished. The "Hand by Hand" mode ends once the last player to be eliminated before the first paid place is eliminated and all remaining players enter the paid places. In certain tournaments, the "Hand by Hand" mode may resume as the final table approaches.
1.9.4. Prize Distribution in Case of Simultaneous Player Eliminations
When multiple players are eliminated simultaneously during the same hand, the player with the largest stack at the start of the hand will be ranked highest. If this occurs when there is only one player left to be eliminated before the first paid place in the tournament, the player with the largest stack at the start of the hand will be paid, and the player with the smallest stack will not receive any payout.
Example: Eleven players are left in a tournament paying out the top 10, with the 10th place earning 20€. Two players are eliminated during the same hand. The one with the larger stack at the start of the hand wins 20€.
If the two eliminated players had the same stack size at the start of the hand, they will share the prize of the next paid position, i.e., 10€ each in cash, regardless of whether the 20€ prize is cash or a tournament ticket. If the amount is odd (e.g., 20.05€), the first player registered will receive 10.03€, and the other player will receive 10.02€.
1.9.5. Deal (Prize Pool Split) in a Tournament
In some cases, players may have the option to share (or "deal") the remaining prize pool during a tournament. All remaining players must agree to make the deal. Eligible tournaments and conditions for such deals are detailed on the website: www.partypoker.fr.
1.10. Multi-table Tournaments and Sit and Go
Partypoker offers two types of tournaments: multi-table tournaments and Sit and Go tournaments. These are scheduled games at a fixed date and time that can accommodate a large number of players, distributed across multiple tables.
Sit and Go tournaments are a specific tournament format that does not start at a set time but begins when the required number of players is reached.
Twisters are fast Sit and Go games with 3 players, where the prize pool is determined randomly.
Details of the various tournament types (multi-table, Sit and Go, Twister) available on the poker platform are provided on the website: www.partypoker.fr.

When multiple players are eliminated simultaneously during the same hand, the prize distribution follows the rules described in section "1.9.4 Prize Distribution in Case of Simultaneous Player Eliminations."
1.11. Tournament Chips and Currency
Tournament chips are a form of virtual currency used in tournament play. Tournament chips are used to determine a player's position in the tournament and do not have any value outside of the specific tournament in which they are used.
Tournament chips cannot be converted into real money (euros) and are not transferrable between players. Players who register for a tournament receive a certain number of tournament chips based on the tournament’s structure. The value of tournament chips depends on the specific tournament and the level of play.
Tournament chips do not count as real money and do not carry over between tournaments. Players who register for a tournament will start with a fixed number of chips based on the tournament's buy-in level, unless where stated in the tournament lobby.
1.11.1. Prizepool Allocation
The total prize pool in a tournament is divided among the players according to the structure provided in the tournament lobby. The prizes are awarded based on the final standings of the players once the tournament has concluded.
For multi-table tournaments, the prize pool is generally distributed to the top finishers, with the largest share going to the first-place player. The specific percentage breakdown of the prize pool is provided in the tournament lobby before registration.
1.11.2. Chip Leaders and Final Rankings
The player who accumulates the most chips during the course of the tournament will hold the chip lead. The tournament continues until one player has all the chips in play, or until the prize pool has been distributed according to the predetermined payout structure.
In cases of multiple players holding an equal number of chips, a tie-breaker may be applied based on the tournament's structure.
The final rankings and prize distribution will be determined once all players have been eliminated except for the final winner(s). If the tournament allows multiple winners (e.g., a split prize pool), the final standings will be divided as agreed upon.
1.11.3. Tournament Registration Fee
The registration fee for each tournament (buy-in) is determined by the tournament organizer. The fee is clearly stated in the tournament lobby and must be paid by the player before they can register. This fee contributes to the prize pool, and a portion may be retained by the operator for operational costs or fees.
If a player wishes to deregister from a tournament, the registration fee may be refunded, depending on the specific rules of the tournament. Players should refer to the tournament rules regarding deregistration.
1.11.4. Additional Costs and Fees
Certain tournaments may have additional costs or fees associated with them. These costs are specified in the tournament lobby. Examples of additional costs may include a service fee, a fee for re-buys or re-entries, and any other fees that are required to participate in the tournament.
1.12. Re-buys and Re-entries
Some tournaments allow players to rebuy into the tournament if they have lost all their chips. A rebuy is typically available during the early stages of a tournament and can be used by players to buy back into the tournament and continue playing.
Re-buys can be made in the form of tournament chips, and players can purchase more chips during the rebuy period for a specified fee. Re-buy periods vary between tournaments and are clearly stated in the tournament lobby.
In addition to rebuys, some tournaments offer the option of re-entering the tournament after being eliminated, allowing the player to buy back into the tournament. Re-entries can be made under the same conditions as re-buys and are available during a set period of time.
Re-buys and re-entries are optional, but they may be required for players who wish to continue competing in the tournament after losing all their chips.
1.12.1. Re-buy Terms and Conditions
The terms for re-buys and re-entries are specified in the tournament lobby and include the buy-in amount, re-buy time limits, and the number of re-buys allowed. Players should review the terms before registering for a tournament with these options.
Re-buys and re-entries may also be limited by the tournament structure and rules. In some cases, a player may only be allowed to rebuy a certain number of times, or there may be a limit on the total number of re-entries allowed in a tournament.
1.13. Special Tournament Formats
In addition to the standard tournament types, there are special formats available for players who wish to try different kinds of poker tournaments. These may include:
- Turbo Tournaments: These tournaments feature faster blind levels, allowing the tournament to progress more quickly than traditional formats. Turbo tournaments are ideal for players who want to play in a shorter amount of time.
- Deep Stack Tournaments: These tournaments start with players having a larger number of chips, which increases the strategic depth and allows for more flexibility in playing the hands.
- Freeroll Tournaments: These tournaments have no entry fee and offer players the chance to compete for prizes without any financial risk. However, they often have a smaller prize pool compared to tournaments with buy-ins.
- Knockout Tournaments (KO): Players earn a bounty for eliminating other players from the tournament. These tournaments feature both a prize pool for finishing in the top places and additional bounty prizes for eliminating opponents.
- Satellite Tournaments: These are smaller tournaments that offer players the chance to win a seat in a larger tournament (e.g., a major tournament like a World Series of Poker event). Players pay a reduced buy-in to enter a satellite tournament, and the prize for winning is typically an entry ticket to a higher buy-in tournament.
A commission is charged by Partypoker on the pots of cash game hands.
This commission is called the "Rake."
A commission is also charged by Partypoker on the entry fees for tournaments and Sit and Go games. This commission is called "Fees."
The commission for multi-table tournaments and traditional Sit and Go games is a percentage of the entry fee. Players can find this information on the dedicated page of the offer or in the tournament lobby on the website www.partypoker.fr.
The rake for Twister formats varies depending on the format. Players can find this information on the dedicated Twister page on the website www.partypoker.fr.
The rake for cash games varies based on the betting level (the size of the blinds) and the number of players at the table, with a maximum amount charged per pot. Players can find this information on the dedicated cash game page on the website www.partypoker.fr.
Furthermore, no rake is charged on the pot when the hand stops during the first betting round (pre-flop), according to the "no flop, no drop" rule.
Only "paid" bets made by one or more players are subject to rake. "Unpaid" bets do not count toward the calculation of the rake.
Example: After a betting round at the flop, the pot amounts to €10 after the rake has been deducted. The turn is revealed, Player A bets €5, and Player B folds. The €5 bet from Player A was not "paid" by Player B, so no rake will be deducted from this €5 bet.
3. Rules for Refunds and Distribution of Winnings in Case of Tournament Interruption
In the event of a technical incident during a tournament, the current hand at each table is canceled, and the players’ stacks will be restored to what they had at the beginning of the hand. Players who have already been eliminated from the tournament at the time of the incident will not be compensated.
For all tournaments canceled before they start, all players who are still registered will be refunded their entry fees, including the "fees" charged by Partypoker.
When a tournament is interrupted before it reaches its conclusion due to an incident, specific refund rules apply for players who are still in the game at the time of interruption or cancellation. The relevant amounts will be refunded to the player’s available balance within 5 business days, which can be extended exceptionally if the circumstances require it and according to the rules set out in the sub-articles below. The rules vary depending on the type of tournament. Refunds and distribution of winnings are made in euros.
The refund and distribution rules outlined in this sub-article may be subject to modifications, affecting both the amount and the nature of the refund, at the sole discretion of Partypoker or its partners, which the player acknowledges and accepts. In such cases, the modifications will be communicated to the players through the publication of the amended rules on the Partypoker online website.
3.1. Multi-Table Tournaments (MTT)
The total prize pool to be distributed among the remaining players corresponds to the total amount collected in the tournament up until the time of interruption (including all entry fees, re-entries, rebuys, add-ons, and associated "fees"), regardless of the tournament guarantee, which is not considered in the calculation of the amount to be distributed if the tournament has not reached its conclusion.
The rules for refunds and distribution of winnings depend on the tournament’s progress at the time of interruption.
If the paid places phase has not been reached at the time of the interruption:
The players still in the tournament at the time of interruption are refunded according to the following rule:
- The "fees" charged by Partypoker.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
If the paid places phase has been reached at the time of the interruption:
The players still in the tournament at the time of interruption are refunded according to the following rule:
- The "fees" charged by Partypoker.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
3.2. Multi-Table Knock-Out Tournaments (MTT KO)
The total prize pool to be distributed among the remaining players corresponds to the total amount collected in the tournament up until the time of interruption (including all entry fees, re-entries, rebuys, add-ons, and associated "fees"), regardless of the tournament guarantee, which is not considered in the calculation of the amount to be distributed if the tournament has not reached its conclusion.
The rules for refunds and distribution of winnings depend on the tournament’s progress at the time of interruption.
In Knock-Out tournaments, each player will receive their own bounty in addition to the shared prize pool.
If the paid places phase has not been reached at the time of the interruption:
The players still in the tournament at the time of interruption are refunded according to the following rule:
- The "fees" charged by Partypoker are refunded.
- Each player receives the amount of their own bounty.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
If the paid places phase has been reached at the time of the interruption:
The players still in the tournament at the time of interruption are refunded according to the following rule:
- The "fees" charged by Partypoker are refunded.
- Each player receives the amount of their own bounty.
- Each player receives an amount equal to the prize the next eliminated player would have received if the tournament had not been interrupted.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
3.3. Flight Tournaments
The rules for refunds and distribution of winnings depend on the phase of the tournament at the time of interruption.
For all tournaments interrupted due to technical issues, if Day 2 of the tournament has not yet started, all players already registered for Day 2 will receive a share of the total prize pool collected from all Day 1s (including all buy-ins, re-entries, rebuys, add-ons, and associated "fees"), regardless of the tournament guarantee, which is not considered in the calculation of the amount to be distributed if the tournament has not reached its conclusion.
Players still in the game on one of the Day 1s at the time of interruption are refunded according to the following rule:
- The "fees" charged by Partypoker are refunded.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
If Day 2 of the tournament has started, the total prize pool corresponds to the total amount collected from all Day 1s (including all buy-ins, re-entries, rebuys, add-ons, and associated "fees"), regardless of the Day 2 tournament guarantee, which is not considered in the calculation of the amount to be distributed if the tournament has not reached its conclusion.
The rules for refunds and distribution of winnings depend on the progress of Day 2 at the time of interruption.
For Mystery Bounty tournaments, all unassigned prizes are added to the prize pool to be shared among the players.
If the paid places phase has not been reached at the time of the interruption:
The players still in the tournament at the time of interruption are refunded according to the following rule:
- The "fees" charged by Partypoker are refunded.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
If the paid places phase has been reached at the time of the interruption:
The players still in the tournament at the time of interruption are refunded according to the following rule:
- The "fees" charged by Partypoker are refunded.
- Each player receives an amount equal to the prize the next eliminated player would have received if the tournament had not been interrupted.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
3.4. Freeroll Tournaments
Freeroll tournaments are not eligible for any refunds.
If registration for the Freeroll tournament was made using a ticket, players will be reissued their ticket.
Remaining prizes will be awarded based on the standings at the time of interruption.
In cases where multiple players have the same number of chips, the first player to register for the tournament will be ranked ahead of the others, and so on.
3.5. Standard Sit and Go Tournaments
If the paid places phase has not been reached at the time of the interruption:

- The "fees" charged by Partypoker are refunded.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
If the paid places phase has been reached at the time of the interruption:

- The "fees" charged by Partypoker are refunded.
- Each player receives an amount equal to the prize the next eliminated player would have received if the tournament had not been interrupted.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
3.6. Twister Sit and Go Tournaments
The prize pool for the Twister, as used in the calculation below, is the one randomly generated at the start of the Twister in question.
If it is a Twister where only the winner takes the entire prize pool:
The players still in the tournament at the time of interruption are refunded according to the following rule:
- The "fees" charged by Partypoker are refunded.
- From the remaining prize pool, 50% is distributed equally among the players, and 50% is distributed proportionally to their number of chips.
If it is a Twister where more than one player shares the prize pool:
The players still in the tournament at the time of interruption are refunded according to the following rule:
- The "fees" charged by Partypoker are refunded.

4.1. License Grant and Duration
Partypoker grants the player, for a limited period that cannot exceed the lifetime of their player account, a sublicense including the non-exclusive, personal, and non-transferable right to use and/or install (i) the poker software directly accessible online via an internet browser from the website "partypoker.fr" offering the online poker game and/or (ii) the downloadable applications from the website "partypoker.fr" offering the online poker game or from a mobile application store and installable on a computer or mobile device (hereafter referred to as the "Software").
This sublicense may be terminated by Partypoker at any time with reasonable notice.
By downloading the Software and clicking "I accept", You agree to be bound by all of the terms and conditions set out in this section 4.2 regarding the Software Licence. If You do not agree to all of these terms and conditions, You are prohibited from downloading the Software.
4.2. Conditions of the Sublicense
This sublicense is granted solely for the purpose of allowing the player to access and play the online poker games offered on “partypoker.fr” via the Software.
The code, structure, and organization of the Software are protected by intellectual property rights, notably copyright. The player is only authorized to use the Software for personal entertainment purposes in accordance with all provisions specified in the present rules of the online poker game offer to which the Software relates and with all provisions specified in the "General Terms and Conditions."
The player acknowledges that the intellectual property rights relating to the Software are owned by Partypoker or its partners who have granted it a license.
The online poker offer is reserved for players, individuals, who are eighteen years or older, residing in metropolitan France, the territories of metropolitan France, Guadeloupe, Guyane, Martinique, La Réunion, Mayotte, Saint-Barthélemy, Saint-Martin, and Saint-Pierre-et-Miquelon, as well as the Principality of Monaco. As a result, the player agrees to use the Software only in the aforementioned territories.
In this regard, the player acknowledges and agrees that it is strictly prohibited to:
- Copy, distribute, publish, decompile, disassemble, reverse engineer, modify, or translate the Software and its documentation;

- Change, edit, modify, restructure the Software or adapt it;

- Prevent or circumvent any control devices in the Software;
- Use the Software for fraudulent purposes or in violation of applicable laws or regulations, such as automated gaming systems (robots or any similar devices).
The player agrees not to use the Software to communicate content contrary to public order, laws and regulations, pornographic, religious, political, racist, defamatory, discriminatory, insulting, or infringing content.
In the event of difficulty in using the Software or complaints related to the Software, the player agrees to contact only Partypoker.
By downloading, using, and continuing to use the Software, the Player declares that they accept these terms of use for the Software as well as, if applicable, updates to these terms of use.
In the event of non-compliance by the player with these terms of use of the Software, Partypoker reserves the right to suspend or terminate the player’s account immediately.
4.3. Warranty Disclaimer
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE IS UNDER YOUR SOLE RESPONSIBILITY, AND THAT THE SOFTWARE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OR ASSERTION OF ANY KIND. BES, ITS LICENSORS AND ITS SUPPLIERS HEREBY EXCLUDE ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT BEING LIMITED TO, IMPLIED WARRANTIES OR CONDITIONS CONCERNING MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT AS REGARDS THE SOFTWARE. NEITHER BES NOR ITS LICENSORS OR SUPPLIERS CERTIFY, WARRANT OR DECLARE ANYTHING WHATSOEVER REGARDING THE USE OF, OR THE RESULTS OF USE OF, THE SOFTWARE IN TERMS OF ITS CORRECTNESS, ACCURACY OR RELIABILITY, OR CERTIFY, WARRANT OR DECLARE THAT THE SOFTWARE WILL FUNCTION WITHOUT INTERRUPTIONS OR ERRORS. YOU WILL BEAR THE FULL RISK, ANY COSTS, AND ALL LIABILITY ASSOCIATED WITH THE RESULTS AND PERFORMANCE OF THE SOFTWARE AND ITS USE UNLESS WE HAVE BREACHED ANY OF OUR OBLIGATIONS.
4.4. Liability Limitation & Force Majeure
BES will not accept any liability where non-fulfilment, or improper fulfilment, of the contract is attributable to the player except in the event of a breach attributable to BES. Moreover, BES's liability is hereby excluded in the event of a damaging act resulting from either an unforeseeable and insurmountable act of an external third party to the supply of the services provided for in the contract, or from an instance of force majeure.
4.5. Title
The Software is protected by copyright laws and by international copyright treaties. BES and/or its licensors and suppliers will retain all their rights, including property rights and all intellectual property rights pertaining to and associated with the Software and its documentation, and to the associated trademarks.
4.6. Termination
The Licence, including all of Your rights to use the Software, will be terminated automatically and immediately if You fail to comply with the terms of this Licence. Upon termination, You shall cease to use the Software immediately and You must delete all copies of the Software. If You have been provided with the Software for a limited "trial period" or similar, Your right to use the Software will end automatically upon expiry of the applicable trial period, and You shall cease using the Software and delete all copies of the same at that point. You expressly acknowledge and agree that BES may have included a feature in the Software that allows BES to disable the Software so you can no longer use it if you breach this Contract and/or to disable the Software so you can no longer use if once Your trial period has expired.
4.7. Amendments
BES reserves the right to amend the terms of this software Licence at any time, at BES's sole discretion, by publishing a new version of the applicable terms and conditions on the partypoker Platform. In this scenario, You will be informed and must accept the new terms and conditions in question before You can continue to use the Software. You acknowledge and agree that BES may disable the Software so you can no longer use it if you do not accept said revised terms and conditions.
4.8. Invalidity
In the event of any provision of this Licence being deemed invalid or not applicable for any reason whatsoever, said provision will be amended where necessary to render it valid and applicable.
4.9. Applicable Law and Place of Jurisdiction
This Licence will be governed by and interpreted in accordance with the applicable law. In the event of any dispute or conflict relating to or arising from this Licence or its implementation, the French courts with jurisdiction in the matter will have express jurisdiction.
5.1. General Provisions
The player agrees to comply with all regulations of Partypoker accepted when creating their player account, as well as with any subsequent modifications.
The player is informed that, as part of the prevention of collusion, fraud, money laundering, and terrorism financing, the progress of the games may be reviewed, and the winnings derived from these games may be withheld during this review, without prejudice to any appropriate measures in case of proven collusion or fraud, such as returning the unduly won gains to the affected players or any other measures provided in the General Terms and Conditions.
The player agrees to play fairly.
In this regard, practices such as deliberately disconnecting to gain extra time for reflection, repeatedly sitting at a poker table without participating in the game, and more generally any practices that result in unfair advantages to the player are prohibited.
The practice known as "Queuing" (waiting in line): which involves a player or group of players intentionally trying to choose or avoid specific opponents in blind sign-up games (games where the player should not be able to choose their opponents) is prohibited.
Poker is an individual game; as a result, any form of assistance between players, in any way, is prohibited. Practices such as playing less aggressively against another player ("soft play"), deliberately losing chips to another player ("chip dumping"), or any other similar practices are prohibited.
The player must always be the individual holder of the player account that allows access to the online poker game offer.
As such, Partypoker prohibits the use of automated gaming systems that allow the player to gain unfair advantages over other players, such as:
- Real-time gameplay assistance software (advice, actions, and decisions made on behalf of the player, optimal strategy calculations based on scenarios entered by the player...),
- Software that compiles and analyzes opponents' gameplay data (data mining...),
- Software intended to automate and optimize table selection (seating scripts...).
The use of robots, virtual machines, software, or any similar device is thus prohibited.
Partypoker will implement, in accordance with applicable legal and regulatory provisions, all necessary means to detect such use by the player. These methods may include detecting such systems among the software and applications running on the player's terminal. If necessary, only the information strictly required to detect this use, such as the name of the prohibited system used by the player, will be accessible by Partypoker.
Partypoker may also request additional information from the concerned player and/or ask the player to provide one or more video recordings of typical game sessions to clarify or confirm any suspicion of prohibited gaming practices under this article.
If behaviors described in this subsection are detected, or if there is evidence or strong suspicion of the use of such devices, Partypoker may, depending on the severity of the facts and if the situation warrants it, end the ongoing games for the player, deny access to certain tables or the poker platform, refuse payment of any winnings or the return of all or part of the account balance, and/or take any other measure in accordance with the provisions of the General Terms and Conditions, such as blocking all operations, or closing the player’s account by any means it deems appropriate or taking any other action it deems necessary. In such cases, the player will be informed of the reason for the action taken by Partypoker.
5.2. Collusion between Players
Any form of collusion is prohibited.
Collusion between players occurs when two or more players at the same poker table attempt to gain an unfair mutual advantage at the expense of other players at the same table, notably by sharing their knowledge of their cards or the strategy to be adopted.
In this regard, Partypoker may immediately exclude the players involved in or suspected of being involved in collusion or attempting collusion from the poker table, without prejudice to any other measure, including those provided by the "general terms and conditions of the online gaming offer."
Partypoker may also, if necessary, terminate the ongoing games for the concerned players, block the possibility for these players to play together again, deny access to specific tables or the poker platform, refuse payment of winnings or return of all or part of their account balance, and/or take any necessary measures and act according to the severity of the facts, in accordance with the provisions of the General Terms and Conditions, including blocking all operations and blocking or closing the player’s account by any means deemed appropriate.
5.3. Use of the Optional Decision-Aid Service in Online Poker
An optional decision-aid service is offered on the online poker platform.
This optional service is a tool provided for all cash game and tournament players.
It helps identify the main gameplay trends of opponents. This service can be turned on or off. The player uses this service at their own risk. As such, this service cannot be held responsible by Partypoker or its partners, as it is only intended as a simple aid to gameplay.
In general, any third-party decision-aid software is used by the player at their own risk. As such, Partypoker cannot be held responsible for its proper functioning.
6. Recording of Games on the Central Computer System of partypoker.fr and/or on the Poker Platform
The recording and sealing of poker game commitments performed by Partypoker and/or on the poker platform are essential conditions for the formation of the contract between the player and Partypoker.
The progression of poker games, as well as actions performed by the player, including game commitments, deposit of funds, wagers deducted from available funds, winnings, payments, changes to personal information, and messages exchanged between players, are recorded by the Partypoker computer system and the poker platform. By express agreement between the player and Partypoker, in the event of a dispute between the player and Partypoker regarding a discrepancy between the information displayed on the player's screen or those shown on a printed screenshot and those recorded and sealed by Partypoker and/or the poker platform, only the latter information shall be deemed valid, without depriving the player of the ability to provide evidence to show that the recorded information suffered a malfunction within the Partypoker system and/or the poker platform.
7. General Conditions for Live Team Events (hereinafter "live tournaments")
7.1. General
7.1.1. Players qualified to take part in a live tournament via partypoker participate in said live tournament as a member of the partypoker Team.
7.1.2. The Player may not exchange a prize of a buy-in for a live tournament for a cash prize.
7.1.3. These General Conditions for Live Tournaments may be substituted with specific live tournament rules by the organiser of the tournament in question. If any one of these General Conditions for Live Tournaments is substituted by a specific live tournament rule, this will not affect the validity of the remainder of these General Conditions for Live Tournaments.
7.2. Substitute Tournament
7.2.1. If the Player cannot participate in a given live tournament, BES may offer the Player the chance to take part in an alternative live tournament of equivalent or lower value. If the alternative live tournament is of a lower value, the Player will receive the difference credited as buy-ins. If no appropriate alternative is available to the live tournament, the prize may be declared forfeited.
7.2.2. If the tournament is cancelled, the Player will be offered an alternative of the same value.
7.2.3. If a live tournament is cancelled, BES will offer the Players registered for that tournament a substitute. The Player my accept or refuse to take part in the substitute tournament. The refund and cancellation terms applicable if Players refuse will be detailed in the terms applicable to the tournament. If the Player is sent to an alternative live tournament, and if BES is not responsible for cancelling the original tournament, BES will not be held liable for any additional costs associated with the new location of the alternative tournament.
7.3. Costs Associated with the Tournament
The following costs associated with a live tournament will be covered by BES for Players who have qualified online and who have won a package that includes the buy-in plus an all-inclusive package for the Player's travel and accommodation expenses:
- Tournament buy-ins: BES will bear the costs of the tournament buy-in.
- Travel and accommodation expenses: BES will grant the Player a fixed sum to cover their travel and accommodation expenses. The total package amount will be clearly displayed on the page promoting the online qualifiers for the live event in question. This amount will be credited to the Player's Account on the partypoker Platform. The Player will be solely responsible for all additional costs, such as meals, room service, phone calls, etc.
In the case of online qualifiers that offer players a direct buy-in (in other words, a buy-in that does not include an "expenses" package), the Player will be responsible for all travel and accommodation costs.
7.4. Obligations
7.4.1. When participating in a live tournament, or any event organised in connection with the same, the Player shall wear partypoker branded clothing visible at all times except where this is expressly prohibited by the tournament organisers.
7.4.2. With regard to their participation in a live tournament, the Player who takes part in online qualifiers expressly agrees to attend interviews and/or other acts organised by public relations agencies on BES's behalf. This may include, without this list being exhaustive, taking part in a daily interview by BES staff and providing any additional information of interest regarding any partypoker site. BES owns the exclusive rights to copy, reproduce and use all or part of the results of these interviews or public relations activities, including photos and videos of the Player. Please see also Article 7.3.4.4. below and our Privacy Policy.
7.4.3. If the Player is interviewed by a third party in connection with a live tournament, they shall mention that they were selected to take part in the live tournament by playing on the partypoker Platform, except where the tournament organisers expressly prohibit such information.
7.4.4. The Player is aware and accepts that BES may use the Player's images and videos, and the Player's name and Player ID used on any BES site, in connection with the information about a live tournament, in accordance with the assignment of rights form signed to this effect when they registered for the tournament.
The Player hereby waives their right to review or approve such use.
7.4.6. If the Player fails to comply with the obligations set out in this contract, they may be excluded from any future competitions in which partypoker Teams take part, including qualifier tournaments and live tournaments. BES shall notify the Player about this ban in writing and inform them of the reasons for and consequences of said ban.
7.4.7. If a Player subject to such a ban does take part in and win a prize in a qualifier tournament as a member of the partypoker Team, the prize will be declared forfeited.
7.5. Additional activities
BES may organise additional activities throughout a live tournament. BES may not be held liable in any way whatsoever for any damage of any kind incurred by the Player during such activities which is not caused by a fault on the part of the BES. The Player will be responsible for their own personal safety at all times and must act accordingly. This applies for the entire period during which the Player acts as a member of the partypoker team.
7.6. Prize Value
The total estimated value of the prize granted to the Player winning access to a live tournament, as indicated on the partypoker Platform, may not be refunded to the Player if they do not participate in all of the activities included in the prize. BES may not be held liable if the Player decides not to participate, or is not able to participate, for personal reasons or for reasons to do with the tournament process.
7.7. Miscellaneous
7.3.7.1. The Player must have reached the age legally required to participate in a live tournament and the Player will be solely responsible for providing evidence of their legal age. BES will be entitled to ask the Player for documentation to verify their legal age at any time.
7.7.2. The Player is solely responsible for ensuring they have any visa that may be required or fulfilling any other conditions, such as any vaccinations that may be needed, required for the Player to enter the country or region where the live tournament is taking place.
7.7.3. The Player shall have a credit or debit card for all costs not covered by BES.
7.7.4. The Player will be personally liable for any taxes associated with the prize winnings.
