Disconnection and Cancellation Policy

Disconnection and Cancellation Policy

This policy is part of the Non-Banking Card Games Services Terms of Use.

  1. This Disconnection and Cancellation Policy ("the Policy") only applies when the Player Non-Banking Card Games Services.
  2. Unless otherwise stipulated, this Policy sets out the rules and procedures that govern the rights of Players in the event of the disconnection and cancellation of a game.
  3. We are committed to providing Our Players with the best possible Policy for protection against disconnections. Our aim is to protect Players while maintaining an appropriate level of monitoring to avoid any corruption of the system.
  4. Disconnection Protection is a tool that was implemented to protect Players if their internet connection fails suddenly when they have already contributed to the pot. If a Player is disconnected, they are permitted to resume the game (only if the incident falls under Our Disconnection Protection) and may continue to claim the portion of the pot financially contributed by them before the disconnection.
  5. This Disconnection Protection only applies in cases of true disconnection. Any wrongful use of this provision may result in the funds in question being frozen, disqualification from the tournament, loss of the ability to benefit from the Disconnection Protection clause, or even expulsion from the site.
  6. Our Software can detect if a Player was actually disconnected accidentally before granting the right to Disconnection Protection. If a Player tries to use the Disconnection Protection by deliberately allowing the time given to them to pass, they will be deemed inactive.
  7. Disconnected Players must simply open a new session and resume play as quickly as possible when this happens. Please contact Your access provider to find out what can be done to minimize these risks. We do not accept any liability for the disconnection of Players not attributable to a failure of the BES Platform.
  8. We reserve the right to amend this Policy at Our sole discretion. Notice of any amendments will be given in a timely manner by electronic means or in writing by Us and must be accepted by You.

Resume Options

If a Player has contributed to a pot and is deemed to have been disconnected, the system will give them additional time to return and rejoin the game.

The additional time granted will depend on the pot size:

  • 20 seconds if the pot is at least 5 big blinds and fewer than 20 big blinds
  • 30 seconds if the pot is at least 20 big blinds and fewer than 40 big blinds
  • 45 seconds if the pot is at least 40 big blinds and fewer than 80 big blinds
  • 60 seconds if the pot is at least 80 big blinds

The system will only wait for extra time if the Player deemed to have been disconnected a) invested in the pot, and b) does not have the option to Check. We call this feature a lifeline.

Lifelines are simply the extra time given to Players to make a decision if they are disconnected when it is their turn. We strongly advise against abusing this feature by penalizing Players who use it intentionally with the risk of losing all of their chips and money.

The Player will have 60 seconds to reconnect. If they reconnect on the 56th second, they will have at least 20 seconds to act: this is the additional bet time-out period.

Players have an unlimited number of lifelines providing the conditions set out above are met.

We will send the Player a chat message when the Software grants additional time following a disconnection.

If a Player deemed to have been disconnected has the option to Check, the Software will take that action automatically without giving them extra time.

Single-table Sit & Go tournaments and Disconnection Protection

We have removed Disconnection Protection from all Sit & Go only table tournaments. You will be deemed inactive if You lose Your connection. This change has been implemented at the request of Our Players.

Multi-table Sit & Go tournaments and Disconnection Protection

Disconnection Protection is not available for this type of tournament. You will be deemed inactive if You lose Your connection.

Multi-table tournaments and Disconnection Protection

Disconnection Protection is not available for this type of tournament. You will be deemed inactive if You lose Your connection. This change has been implemented at the request of Our Players.

Game cancellation policy

This policy applies in the event of disruption to BES' servers terminating ongoing tournaments or poker games.

Real-money games

Players will be refunded the exact amount in their possession at the time of the cancellation.

Play-money games

Players will be refunded the exact number of chips they brought to the table as We do not keep records for play-money hands.

All real-money tournaments (Sit & Go and scheduled)

If a tournament is cancelled for technical reasons, the following refund policy will take effect:

  • If the tournament has not yet started: All Players will be refunded their buy-in.
  • If the tournament has started and tournament registration is still open (in other words, late registration is still possible):
  • Players eliminated when the game was cancelled will not be refunded their buy-ins.
  • All Players in the tournament will be refunded their buy-in and their stack.
  • All stacks (excluding buy-ins) paid by Players eliminated from the tournament will be distributed based on a percentage to the remaining Players according to the number of chips they each have left.
  • The tournament will only credit funds collected in the form of stacks. Guaranteed prize pool sums will not be included when calculating winnings.
  • If the tournament has started and tournament registration is closed:
  • The Players eliminated when the game was cancelled will not be refunded their buy-ins.
  • The Players still in the tournament will be allocated a sum equal to what would have been given to the next eliminated player. 50% of the remaining prize pool will be distributed evenly between the remaining Players and 50% on the basis of a percentage calculated based on each Player's number of chips. The remaining Players will also be refunded their buy-ins.

In exceptional circumstances, where the quality of Our Services is substantially impaired, due to an instance of force majeure, as interpreted by case law, and, without this list being exhaustive, a terrorist attack, fire or a Denial-of-Service (DoS) attack, We reserve the right to cancel tournaments and refund Players their buy-ins, but only where the prize pool amount is less than the guaranteed prize pool. In this scenario, We will refund all Players their buy-in, including Players already eliminated at the time of the cancellation.

Arrangement

If You are disconnected while in the process of negotiating an arrangement (enabling Players still in to deviate from the prize pool offered on the site), this will continue as though You were still online. One of the following scenarios may happen:

  • You reconnect while the arrangement is still in progress and have time to participate.
  • You do not reconnect before the arrangement is rejected because the time allowed to conclude the arrangement has expired.
  • The other Players rejected the arrangement while You were disconnected and play resumes.
  • A disconnection is deemed to be an implied rejection of the arrangement: If an arrangement has to be accepted by all Players seated at a table, it will be rejected unless You manage to reconnect and confirm within the time allowed.
